Modification or use of the materials for any other purpose violates ALBAIK’s intellectual property rights. All materials on the website, including but not limited to audio, images, software, text, and video clips (Contents), are protected by copyright and trademark laws and regulations. There will be no compensation for any submission monetary, recognition or any other manner. All submissions are voluntarily shared and agreed as such. While ALBAIK values customer feedback ALBAIK does not accept unsolicited ideas or suggestions.

We reserve the right to block your access to the site for any reason and / or at anytime without any prior notice, we have the right to delete, cancel and suspend all information you may post or register as such without any prior notice and prohibit your access to any data, information or files you may have uploaded.

• We confirm that any / all information we have uploaded on the site is accurate and true however we are not fallible and have put in effort to avoid any mistakes and strive to amend. We have made reasonable efforts to avoid any mistakes as such, however should you come across any information you feel may not be accurate on the site please don’t hesitate to send us your comments as such immediately.

Any personal information you upload / transmit to the website through any means will be utilized by the Company in accordance with set privacy policy of the site and as the Site by any means, will be utilized by the Company in accordance with the privacy policy of the site, and any other material you transmit to the website will be treated as non-confidential.

Compensation

Violation of any of these conditions, whether through the use of the site and / or services associated with it or violating the rights of others, including, but not limited to (rights to publishing and trade secrets, privacy, trademark) and those rights associated with the other parties, and that any abuse of any of these conditions the violator will bear all expenses and costs incurred by the Company during and throughout any legal prosecution and handling.

Independence of the text

If any of the terms and conditions set forth in this agreements or any points mentioned come about to be unenforceable or non-implementable based on special judicial entities input for any reason will not in any means have any effect on the other points and conditions within the terms and conditions agreement of this site or any legal effect; and the set cancellation will be limited in the particular case or incident and no party can try to affix to it as such even if such a cancellation precedes these terms and conditions or comes post.

Jurisdiction

The terms and conditions set in this Website are all governed, construed and enforced according to the laws of the Kingdom of Saudi Arabia, and in the event of any disagreement or dispute in the application or interpretation of any provision of these conditions shall be referred to and heard by the Saudi Arabian judicial authority.

Refunds & Cancellations for ALBAIK App Terms of Use

1. GENERAL CANCELLATION POLICY:

   We strive to serve your meals fresh and customized to your preferences. Once you submit your order through "Deliver to an address", "Pickup from a restaurant", or "Scan to Order", you will have a brief cancellation window. If you request a cancellation before our team begins preparing your order, we may permit a full refund of your payment, at our sole discretion. However, once the preparation process has started, the order cannot be cancelled, refunded, or exchanged.

2. REFUND/EXCHANGE POLICY:

   Notwithstanding the foregoing, we operate a refund/exchange policy as follows:

   (a) Pre-preparation cancellation:

   If you request to cancel your order after completing payment and once the cancellation window has passed, but before we begin preparing your order, we may, in our sole discretion, permit you to cancel your order and receive a full refund subject to payment having already been made in full for your order.

   (b) Post-preparation exceptions:

   After your order has been prepared and handed over, we only permit refunds (full or partial) or exchanges in specific, verified circumstances. You are eligible if you receive incorrect items, missing items, or if the order was not prepared as requested, such as containing the wrong ingredients. We will also process a refund if the meal contains items that are defective, substandard, or otherwise not suitable for consumption (provided you supply supporting evidence), if there are billing and pricing errors, or if technical issues on our end prevented your order from being fulfilled. To maintain fairness, we cannot offer refunds if you simply change your mind, place an incorrect order yourself (such as selecting the wrong items, quantities, or restaurant), partially consume the food, or reject the meal based on personal taste. Please ensure you communicate any dietary restrictions or food allergies before placing your order, as we cannot issue refunds for this reason afterward.

3. Specific Rules for "Deliver to an address":

   When you choose "Deliver to an address", you are entitled to cancel your order and request a full refund without a valid reason if your delivery time exceeds (90) minutes and you were not notified of the potential delay. You are also eligible if we are unable to deliver the order to your specified location for any reason related to us or the delivery service. We may be unable to provide a refund for delays caused solely by events outside our reasonable control, such as severe weather, disasters, or other force majeure events. However, we will review each case fairly in accordance with applicable law and our customer service standards. We cannot issue delivery refunds if you provide incorrect GPS address information, if you are unresponsive when the driver arrives, fail to respond within (15) minutes of their arrival, or fail to meet the driver at restricted access locations despite being notified.

4. Specific Rules for "Pickup from a restaurant" and "Scan to Order":

   If you use the "Pickup from a restaurant" or "Scan to Order" services, you are entitled to a full refund if your meal is not ready (30) minutes after the maximum estimated pickup time shown in the app, provided you arrive for pickup at the expected time. Please note that we cannot process refunds if you fail to collect your order before the restaurant closes at the end of the working day.

5. Refund "Procedure" and "Timelines":

   If you need to request a refund for any of our services ("Deliver to an Address", "Pickup from a Restaurant", or "Scan to Order"), please call our Customer Service team on (8002442245) within 24 hours of receiving your order during our actual working hours as stated in our App. Our team will review your request by verifying the order details, proof of purchase, delivery logs, and any supporting evidence like photos. Approved refunds will be processed back to your original payment method as soon as possible. If an approved refund is not credited within 15 days, please contact our Customer Service team first so we can review and escalate the matter with the relevant payment service provider where required. You may also contact your bank to check the refund status.

6. STATUTORY RIGHTS:

   Notwithstanding these terms, your statutory legal rights are not affected.

   LEGAL BASIS: Pursuant to KSA E-Commerce regulations, the standard 7-day right of termination does not apply to customized products like our prepared meals. However, your 24-hour complaint window remains fully applicable, and these terms do not affect your standard statutory legal rights.
